1. Agreement to Terms

4. User Content and Licenses
- Ownership: You retain all rights in and to the audio files, artwork, titles, descriptions, metadata, and other content you upload (User Content).
- License to Us: You grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, cache, transcode, reproduce, modify solely for formatting and technical purposes, distribute, publicly perform, publicly display, and otherwise make your User Content available through the Service and any distribution channels you opt into.
- Promotional Uses: With your permission, we may use your publicly available show title, artwork, and excerpts to promote the Service. You may withdraw permission by contacting support@melospot.org, and we will cease future promotional use within a reasonable time.
- Responsibility: You are solely responsible for your User Content. You represent and warrant that you have all necessary rights, licenses, and permissions; that your content does not infringe the rights of others; and that your use complies with law and these Terms.
- Music and Third-Party Materials: If your podcast includes music, samples, or other third-party content, you are responsible for obtaining and maintaining all required licenses.
5. Prohibited Conduct
You agree not to upload or distribute illegal, infringing, hateful, harassing, threatening, abusive, deceptive, defamatory, or obscene content; upload malicious code or attempt to circumvent security features; interfere with or disrupt the Service or servers; engage in scraping or automated data extraction except as permitted by our robots.txt or written consent; impersonate any person or entity or misrepresent your affiliation; or use the Service in violation of any law or regulation.
6. Distribution and Third-Party Platforms
We may facilitate distribution of your podcast to third-party platforms that you choose. Those platforms are governed by their own terms and privacy policies. We do not control third-party platforms and cannot guarantee removal timelines or policies once content is distributed externally.
7. Service Changes and Availability
We may change, suspend, or discontinue all or part of the Service at any time, with or without notice, and without liability to you. We aim for reliable uptime but do not guarantee uninterrupted or error-free operation.
8. Intellectual Property
The Service, including software, features, and branding, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license to access and use the Service, no rights are granted to you. If you submit feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation.
9. Copyright Complaints (DMCA)

We do not warrant that the Service will be secure, uninterrupted, or error-free, or that content will be preserved or stored without loss.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MeloSpot Unplugged AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM OR 100 dollars. Some jurisdictions do not allow certain limitations; in those cases, the above limitations apply to the fullest extent permitted by law.

You agree to indemnify and hold MeloSpot Unplugged, its affiliates, and their officers, directors, employees, and agents harmless from any claims, damages, liabilities, costs, and expenses including reasonable attorneys fees arising out of or related to your User Content, your use of the Service, your violation of these Terms, or your violation of any third-party rights or law.
